Wispyr Terms of Use

Wispyr is an unofficial app that uses the Telegram API. It is not affiliated with, endorsed by, or sponsored by Telegram FZ-LLC or its affiliates.

1. Scope

These terms govern your use of the Wispyr app (the “App”) provided by Wispyr (the “Operator”).

2. Relationship with Telegram

  1. The App is a client for the Telegram service. Accounts, messages, calls, channels and the messaging service itself are provided by Telegram.
  2. Your use of the messaging service is also governed by the Telegram Terms of Service and the Telegram Privacy Policy, which you must accept to use the App.
  3. Actions concerning the Telegram service, such as account restrictions or content limits, are taken by Telegram. The Operator cannot influence or reverse them.

3. Features and local security

  1. The App can encrypt the data it stores on your device with a key held in the device’s secure hardware and a passcode you choose.
  2. If you forget your passcode, the encrypted on-device data cannot be recovered. The Operator does not hold your passcode or any recovery key. Chats stored on Telegram’s servers are available again after you log in.
  3. The Operator may add, change or discontinue features of the App.

4. Open source license

The App is based on the Telegram for Android source code, distributed under the GNU General Public License version 2 (GPLv2). The App’s source code is available at https://github.com/wispyr/wispyr-android, and you may use, modify and distribute it as permitted by the GPLv2.

5. Acceptable use

You must not:

  1. violate applicable law or the Telegram Terms of Service;
  2. use the App to infringe the rights of others or to distribute spam or malware;
  3. interfere with the App or with servers operated by the Operator, such as the language pack server;
  4. impersonate the Operator or Telegram.

6. Changes to supporting services

The Operator may change or discontinue services that support the App, such as the language pack server. Material changes are announced in advance in the App or on this page.

7. Disclaimer and limitation of liability

  1. The App is provided “as is”. To the extent permitted by law, the Operator makes no warranty as to its accuracy, fitness for a particular purpose or uninterrupted availability.
  2. The Operator is not liable for damage caused by outages, changes or policies of the Telegram service, or by your device or network environment.
  3. Nothing in these terms limits liability that cannot be limited under applicable law, including liability for intentional misconduct or gross negligence.

8. Changes to these terms

The Operator may update these terms. Updates are announced in the App or on this page at least 7 days before they take effect (30 days for changes that are unfavorable to you).

9. Disputes

If you have a problem with the App, please contact us first at admin@wispyr.app so we can try to resolve it. Disputes that cannot be resolved this way are handled by the court that has jurisdiction under applicable law. Nothing in these terms affects the protection you have under the mandatory laws of the country where you live.
